Air

 

H1646, Increase Penalties for Air Pollution, Lucy Allen (Franklin-D), Pryor Gibson (Anson-D); co: Brown, Faison, Harrison, Insko, Weiss. Increases maximum penalties for violating various air pollution standards, permits and emission limits from $10,000 to $25,000 per day. SL 2007-296.

 

H1758, Mercury Switch Removal Prgm. Amends, Lucy Allen (Franklin-D), Pryor Gibson (Anson-D); co: Faison Makes amendments to the statute adopted last year which requires auto scrap recyclers to remove mercury-containing switches from cars before recycling them. The bill modifies reporting requirements, references coordination with pending federal switch recovery program, and includes a requirement that cars that have had switches removed be marked to make facilitate enforcement. SL 2007-142.

 

H1912, School Bus Retrofits in Nonattainment Areas, Ruth Samuelson (Mecklenburg-R), Jim Harrell (Surry-D), Grier Martin (Wake-D), Jeff Barnhart (Cabarrus-R); co: Adams, Alexander, Avila, Blackwood, Braxton, Brown, Carney, Coleman, Cotham, Current, Faison, Glazier, Gulley, Harrison, Holliman, Hurley, Jeffus, Jones, Justus, Killian, McGee, Rapp, Ross, Stam, Tarleton, Thomas, Walend, Weiss, Wiley, Wilkins, Wray, Yongue. Establishes a pilot program to retrofit school buses in the 24 counties that are not meeting federal air quality standards (are in “non-attainment”) with pollution control devices for particulates and crank shaft ventilation. S509, Motor Vehicle Inspection Failure/Reinspection, Harry Brown (Onslow-R). Extends the window a vehicle owner can have their car reinspected and lowers emissions violation penalties. SL 2007-364.

 

S617, Mecklenburg County Carpooling Exemption, Goodall (Union-R). Allows Mecklenburg County employees who use county vehicles for work to also use them for carpooling. SL 2007-136.

 

Energy

 

H177, Comm. Coll./Participate in Energy Loan Prog., Joe Tolson (Edgecombe-D). Authorizes community colleges to get energy improvement loans. SL 2007-476.

 

H1097, Local Energy Efficiency Incentives, Verla Insko (Orange-D). Allows Asheville, Charlotte, Wilmington, Carrboro and Chapel Hill to provide development incentives, such as allowing higher density development, in exchange for significant energy conservation measures. SL 2007-241.

 

H1702, Conserve Energy/Insulate Hot Water Plumbing, Bill Faison (Orange-D), Lucy Allen (Franklin- D). Directs the Building Code Council to study whether to require hot water pipes in new construction to be insulated. It costs $120 to insulate the average house, and would result in savings of $117 in the first year. SL 2007-542.

 

HJR1976, Gruber Confirmation, Drew Saunders (Mecklenburg-D). Confirms Robert Gruber as

Executive Director of the Public Staff of the NC Utilities Commission through June 30, 2013, as appointed by Governor Easley. SL 2007-48.

 

S3, Promote Renewable Energy / Baseload Generation, Charlie Albertson (Duplin-D). Creates a 12.5% Renewable and Efficiency Portfolio Standard for investor-owned utilities to achieve by 2021 (10% for other power providers), including set-asides for solar, hog waste and poultry liter incineration. Also provides baseload financing incentives for new coal and nuclear power plants, and a tax break on energy for manufacturers and farmers. Also requires computer manufacturers to establish take-back computer recycling programs. SL 2007-397.

 

SJR225, Confirm Edward Finley to Utilities Comm., R.C. Soles (Columbus-D). Final legislative

approval for Governor Easley’s appointment of Edward Finley to replace Jo Anne Sanford on the NC Utilities Commission. RES 2007-16.

 

S530, Raleigh/Contracts Exemption, Janet Cowell (Wake-D). Facilitates Raleigh’s pilot program to install high efficiency LED lighting by exempting them from competitive bidding requirements. Also allows Raleigh to raise vehicle tax from $5 to $20. SL 2007-333.

 

S581, Building Permit Rebates/Reductions, Dan Clodfelter (Mecklenburg-D). This bill authorizes local governments to provide building permit reductions or rebates to builders who build to a nationally recognized green building standard, such as LEED or Green Globe. SL 2007-381

 

S668, Energy Conservation in State Buildings, Janet Cowell (Wake-D); co: Albertson, Atwater, D. Berger, Brock, Dalton, Foriest, Garrou, Goss, Graham, Hartsell, Jones, Kinnaird, Malone, Nesbitt, Pittenger, Purcell, Queen, Snow, Stevens, Swindell. Requires new and renovated state-owned buildings (including university and community colleges) to be constructed to meet high performance building standards and reduce water consumption. Also requires the state to conduct energy audits every 5 years, and requires life-cycle cost analysis for state building projects. SL 2007-546.

 

S670, Use of Solar Collectors, Janet Cowell (Wake-D). Prohibits local ordinances, deed restrictions or covenants from prohibiting solar panels on single family homes beginning October 1, 2007. SL 2007-279.

 

S1178, Master Meter for Electric/Natural Gas, Charlie Albertson (Duplin-D). Allows use of master meters in hotels that have been converted to condominiums. SL 2007-98.

 

Energy - Transportation

 

S567, Allow Distribution of E-Blend Fuel, Walter Dalton (Rutherford-D). Allows ethanol-blend fuel to be dispensed from equipment that meets the requirements for gasoline dispensing equipment. SL 2007- 82.

 

S1272, Motor Fuel Tax Exemption for Biofuels, John Snow (Cherokee-D). Provides a tax credit for biodiesel producers, and to exempt small home-brew biodiesel producers from the motor fuel excise tax; currently those who make biodiesel for their personal use have to register with the state, meter their use, and pay the excise tax. The bill also designates the Department of Agriculture as the lead agency for biofuel issues. SL 2007-524.

 

S1277, State Diesel Vehicles Warranties/B20 Fuel, John Snow (Cherokee-D). Even though biodiesel can be used directly in any diesel engine safely, some vehicle manufacturers will void a warranty if biodiesel is used. This bill requires that diesel vehicles purchased by the state have a manufacturer warranty that covers the vehicle if biodiesel in a 20% blend with diesel (B20) is used. SL 2007-420.

 

S1452, Diesel School Buses to Use Minimum B-20 Fuel, John Snow (Cherokee-D); co: Allran.

Requires that all diesel school buses also be capable of running on biodiesel in a minimum 20% blend (B-20). SL 2007-423.

 

Coastal

H429, Canal Dredging Fee/Brunswick Fire Fee, Bonner Stiller (Brunswick-R). Authorizes Ocean Isle, Emerald Isle and Holden Beach to set canal dredging fees based on the footage of property fronting the water. Also modifies fire protection fees in Brunswick County. SL 2007-335.

 

H942, Oak Island Beach Nourishment Project, Bonner Stiller (Brunswick-R). Authorizes the Town of Oak Island to charge property owners for beach nourishment projects prior to their construction in order to have funds to meet local match requirements, with the caveat that the funds would be returned if the projects are not contracted within 4 years. SL 2007-161.

 

H1017, Brunswick Menhaden Restrictions, Bonner Stiller (Brunswick-R), Dewey Hill (Columbus-D); co: Daughtridge, Folwell, Gulley, Justice, Killian McGee, Samuelson, Steen. Restricts fishing for menhaden with purse seine nets off the coast of Brunswick County from May through October. SL 2007-320.

 

S103, Various Special License Plates, Eddie Goodall (Union-R). Among other things, this bill increases the fee for the NC Coastal Federation’s special license plate by $5.00. SL 2007-483.

 

S646, Enact Waterfront Access Study Comm. Recommendations/Funds, Charlie Albertson (Duplin- D). Promotes traditional coastal uses in the face of rampant coastal development by allowing piers and fish houses to get the lower “present use value” tax rate, creates an advisory committee on working waterfront access, directs DOT to consider access issues, raises boating fees, and waives emergency CAMA permit fees. SL 2007-485.

 

S1453, Oyster Shells/Highway Beautification, Clark Jenkins (Edgecombe-D); Albertson, Boseman, Soles, Swindell, Weinstein. Prohibits the use of oyster shells as ground cover along highways, directing them instead to be provided to the Division of Marine Fisheries for building oyster habitat. Senate Transportation. SL 2007-84.

 

Land / Habitat Conservation / Recreation

 

H463, Conservation Tax Credit Modifications, Paul Luebke (Durham-D); co: Blust, Brubaker, Carney, Church, Faison, Fisher, Glazier, Harrison, Hill, Rapp, Wainwright, Weiss, and Wilkins. Currently a tax credit is available for property donations for public access and fish or wildlife conservation. This bill extends the tax credit to include donation of property for a broad array of land conservation uses, and extends eligibility for the credit to pass-through entities. SL 2007-309.

 

H862, Amend Plant Protection and Conservation Act, Dewey Hill (Columbus-D); co: Faison. Makes various changes to this Act, including authorizing Plant Conservation Board to establish permit fees, clarifying that Scientific Committee of the Board may review and comment on state projects that may impact plant habitat but their approval is not required, changes one position on the Scientific Committee from one of three specified non-profits to a more generic “conservation organization,” and changes violations from Class 3 to Class 2 misdemeanor. SL 2007-456.

 

H1499, Property Tax and PUV Changes/Studies, Grier Martin (Wake-D), Hugh Holliman (Davidson-D), Ray Warren (Alexander-D), Braxton (Lenoir-D). Authorizes the Revenue Laws Study Committee to study proposals to allow present use value tax status for lands managed for wildlife as well as two other studies of possible tax incentives for farmland preservation and for perpetual easements, and creates a new category of present use value for aquaculture. The bill also includes a ‘circuit-breaker’ provision allowing low-income retirees and permanently disabled residents to defer property taxes so they can stay in their homes. SL 2007-497.

 

H1724, State Nat. & Hist. Pres. Addns. & Removals, Bob England (Rutherford-D). A procedural bill that dedicates all lands acquired by the state since the last dedication as part of the State Nature and Historic Preserve. This adds about 20,000 acres, including Chimney Rock State Park, and also disposes of some small parcels to allow for road relocation or utility easements. SL 2007-307.

 

S153, Mattamuskeet Lodge Maintenance, A.B. Swindell (Nash-D). Transfers responsibility of the lodge from the federal government to the Wildlife Resources Commission and allows use of renovations reserve account funds. SL 2007-13.

 

S1383, Allow Cyclists to Use Public Lands, Clark Jenkins (Edgecombe-D). Establishes a process by which bicyclists can enter into agreements with DENR to develop cycling trails on state land. SL 2007- 449.

 

S1431, Deep River / State Park Adds./Parks Authority Members, Bob Atwater (Chatham-D).

Authorizes the addition of Deep River State Trail in Randolph, Moore, Lee, and Chatham counties to the State Parks System. Also adds 4 members to the Parks and Recreation Authority – 2 Governor appointees and one each by the House and Senate. SL 2007-437.

 

Land Use / Development

 

H1213, Cary Multifamily Development/Recreational Land Jennifer Weiss (Wake-D). Authorizes the Town of Cary to require developers of multifamily developments to provide funds for recreational land to serve residents. SL 2007-321.

 

H1217, Navassa Annexation Agreement, Bonner Stiller (Brunswick-R), Dewey Hill (Columbus-D). Authorizes this Town of Navassa to accept payment ($1.2 million over 10 years) in exchange for not annexing a 615 acre tract of land owned by DAK Americas LLC, a chemical factory. SL 2007-314.

 

S609, Chatham Recreation Exaction Fee, Bob Atwater (Chatham-D). Allows Chatham County to enter into development agreements requiring developers to fund recreational lands. Chatham County already has authority for development agreements, but this changes purposes for which fee can be used. SL 2007-339.

 

S831, Wireless Telecommunication Facilities, David Hoyle (Gaston-D). This bill limits the ability of local governments to regulate cell phone towers. SL 2007-526.

 

S1152, Interest on Illegally Levied Exactions, David Hoyle (Gaston-D). States that if a city or county illegally exacts a fee (such as an impact fee on developers) and, following a court case, has to pay it back later, the local government must pay it back with 6% interest. SL 2007-371.

 

S1167, Notify County Before State Land Acquisition, Katie Dorsett (Guilford-D); co: Graham.

Requires the state to give notice to counties before they acquire, through purchase or gift, land in the county with an appraised value over $25,000. SL 2007-396.

 

S1313, Zoning Near State Capitol, Janet Cowell (Wake-D). Preempts the City of Raleigh’s zoning of state owned buildings within 6 blocks of the state capitol. This will, for instance, override the City’s requirement that the Jones St. parking deck be mixed-use. The deck is to serve the Green Square Project which will house DENR and a Museum of Natural Sciences expansion. SL 2007-482.

 

S1482, Municipal ETJ Street Standards, Dan Clodfelter (Mecklenburg-D). Requires developers who build streets in subdivisions within the extraterritorial jurisdiction of a municipality to either certify that the street will be maintained by DOT or meet standards prescribed by the municipality. It seems to stem from a situation in Charlotte and a negotiated agreement between the Attorney General’s office, DOT and the City of Charlotte. SL 2007-440.

 

Toxics

H36, Hazardous Materials Task Force Recommendations, Jennifer Weiss (Wake-D), Deborah Ross(Wake-D), Ty Harrell (Wake-D), Nelson Dollar (Wake-R). This bill tightens hazardous waste facility rules and regulations by implementing most of the recommendations from the Governor’s Task Force established in response to the Apex hazardous waste facility fire in 2006. SL 2007-107.

 

S1362, Amend Dry-Cleaning Solvent Cleanup Act, Dan Clodfelter (Mecklenburg-D). Increases the annual cap for spending on cleanup of sites contaminated by dry-cleaning solvent, revises the copayment scheme and creates a one-time application fee; allows DENR to use part of the fund for investigating potentially contaminated sites; authorizes the EMC to reject applications made by dry cleaners with bad compliance records; clarifies that cleanup will be conducted by independent contractors of the Environmental Management Commission; and gives authority for the EMC to adopt temporary rules in the event that its proposed permanent rules (which were approved by the EMC in early July) are subject to legislative review. SL 2007-530.

 

Transportation

 

H292, Accelerated Yadkin River Bridge Project, Lorene Coates (Rowan-D), Fred Steen (Rowan-R). Authorizes the Turnpike Authority to study and conduct preliminary design work of a toll bridge over the Yadkin between Davidson and Rowan counties to replace the existing bridge. SL 2007-299.

 

H513, Charlotte/Transit Procurements & Contracts, Saunders (Mecklenburg-D). Amends the City of Charlotte charter to give them more flexibility in awarding contracts for transit projects and facilities. SL 2007-205.

 

H802, Contract Power/DOT, Margaret Dickson (Cumberland-D); co: Alexander, Allen, Current. Gives DOT authority to contract for infrastructure improvements, and authorizes them to contract for litter removal from roadside right-of-ways. SL 2007-439.

 

H1005, Various Transportation Changes/Study, Nelson Cole (Rockingham-D). After severe flooding during Hurricane Floyd which washed out bridges and damaged associated infrastructure like power lines and sewer lines, DOT began a practice of elevating their bridges over streams. This bill contains a provision that undoes that policy by requiring DOT to construct bridges to accommodate the 100 year flood level, which, in the coastal plain especially, is not strong enough. The bill further says bridges shall be built “without regard for riparian buffer zones” and expressly prohibits rules or agreements between departments contrary to this mandate. SL 2007-551.

 

Waste / Recycling

 

H267, ABC Law Changes, Pryor Gibson (Anson-D). Among other things, this bill tweaks the law

requiring bars to recycle beverage containers by delaying the effective date to 2009, requiring ABC permittees to submit recycling plans and saying permits cannot be revoked for failure to comply. SL 2007- 402.

 

H1456, Solid Waste Management Authority Property, Alice Underhill (Craven-D), William Wainwright (Craven-D). Gives the state’s two solid waste management authorities the ability to purchase specialized equipment outside the normal low-bid procurement process. SL 2007-131.

 

S6, Amend Solid Waste Management Act of 2007, David Hoyle (Gaston-D). Gives landfill companies compensation for money they’ve spent (excluding land and lobbying costs) planning their landfills which would not be able to be built due to the buffer restrictions in S1492; the funds come off the top of the $2.00 per ton tipping fee enacted in S1492. Also redistributes a portion of the tipping fee revenues directly to counties and cities based on population. SL 2007-543.

 

S1472, Revised Dist. of Scrap Tire Disposal Tax, Charlie Albertson (Duplin-D); co: Allran, Kerr,

Kinnaird. Makes some slight adjustments in how proceeds of the scrap tire disposal tax are distributed, increasing allocations to counties and the solid waste management trust fund, and decreasing funds to the scrap tire disposal account. SL 2007-153.

 

S1492, Solid Waste Management Act of 2007, Dan Clodfelter (Mecklenburg-D); co: Albertson. Reforms the solid waste landfill permitting process in a broad number of ways, including increasing financial assurances from landfill companies, requiring environmental review for siting landfills, establishing a 200 foot buffer from streams and wetlands, and other buffers from various public lands, requiring liners on construction/demolition landfills, implementing a $2.00 statewide tipping fee to provide funds to cleanup old contaminated dump sites and recycling programs, and requiring computer manufactures to implement recycling programs for their products. SL 2007-550.

 

Water Quality

 

H810, Clarify Animal Waste Technical Specialist Req., Pryor Gibson (Anson-D), Lucy Allen (Franklin-D). Clarifies the training requirements for animal waste technical specialists, extends the pilot project for annual inspections of animal waste systems to 2009, and clarifies water quality enforcement provisions. SL 2007-536.

 

H859, Nutrient Offset Program Transition, Pryor Gibson (Anson-D), Lucy Allen (Franklin-D). Last year, at the behest of the developers, the legislature reversed the Environmental Management Commission’s fee increase for the nutrient offset program, reverting the fees to their lower inadequate amount while the issue was studied. Based on the study, this bill sets the fee at around $28 per pound for nitrogen in the Neuse, $22 for nitrogen in the Tar-Pam, and $28 for phosphorous in the Tar-Pam, and directs DENR to transition to a program based on actual cost of mitigation. SL 2007-438.

 

S1465, Swine Farm Env. Performance Standards, Charlie Albertson (Duplin-D); co: Allran, Apodaca, Atwater, Berger of Rockingham, Blake, Brock, Brown, Brunstetter, Clodfelter, Cowell, Dalton, Dannelly, East, Foriest, Forrester, Garrou, Graham, Hoyle, Hunt, Jacumin, Jenkins, Jones, Kerr, Kinnaird, Nesbitt, Pittenger, Preston, Purcell, Queen, Rand, Shaw, Smith, Snow, Stevens, Swindell, Tillman, and Weinstein. This bill establishes environmental performance standards that new or expanded hog waste management systems must meet, effectively making the ban on new lagoon/sprayfield systems permanent and funds a cost-share grant program to help farmers convert their lagoons to cleaner technologies. Also authorizes a pilot project of 50 farms capturing methane from existing lagoons to sell for energy production, and includes a provision that allows failing lagoons to be replaced if the lagoon poses an imminent hazard to public health or the environment. SL 2007-523.

 

S1468, Promote Innovative Water Protection Efforts, Charlie Albertson (Duplin-D); co: Atwater, Hunt, Kinnaird. Adds innovative stormwater management planning or research projects to the list of things the Clean Water Management Trust Fund can fund. Intended to facilitate NC State University’s purchase of land for a golf course on the Albermarle Sound in Columbia (Tyrrell County). SL 2007-549.

 

Water Allocation

 

H820, Amend Interbasin Transfer Laws, Lucy Allen (Franklin-D), Pryor Gibson (Anson-D). Makes significant changes to the Environmental Management Commission’s process for evaluating and awarding interbasin transfer certificates for water transfers from one river basin to another, and calls for a comprehensive study of surface water allocation issues by 2009. The bill exempts several eastern counties that are dealing with groundwater supply issues from the new process for a few years, and also does not affect the controversial Concord-Kannapolis transfer. SL 2007-518.

 

Water Infrastructure

H401, County Water/Sewer District Financing, James Langdon (Johnston-R); co: Daughtry, Faison. Allows county water and sewer districts to engage in installment purchase financing. SL 2007-226

 

H1370, Clean Water Grants, Alice Underhill (Craven-D), William Wainwright (Craven-D); co: Faison, Wray. This bill would make wastewater planning and technical assistance grants exempt from the ‘highunit- cost threshold’ which requires that the average fee per household exceed a certain percentage of median household income. SL 2007-185.

 

S403, Charlotte/Water and Sewer Facilities, Dan Clodfelter (Mecklenburg-D). Allows the city to

consider more than cost in awarding contracts for design, building and operation of water and sewer facilities. SL 2007-312.

 

Wildlife

 

H203, Extend Johnston Rabbit Season, Leo Daughtry (Johnston-R). Extends rabbit hunting season in Johnston County to be the same as other counties. SL 2007-64.

 

H571, Moore County Fox and Coyote Trapping, Joe Boylan (Moore-R). Establishes a season for hunting foxes and coyotes in Moore, Cumberland and Harnett counties and establishes a bag limit for foxes. SL 2007-11.

 

H1176, Tyrrell County Hunting, Bill Owens (Pasquotank-D). Prevents reckless use of firearms or bow and arrow, and regulates hunting along State roadsides. SL 2007-273.

 

H1185, Johnston County Fox Hunting, James Langdon (Johnston-R); co: Daughtry. Establishes a season for fox hunting in Johnston County, with no requirements for tagging and no bag limit. SL 2007-47.

 

S50, Reciprocity of Disabled Hunting Licenses, Charlie Albertson (Duplin-D). Directs WRC to

investigate the potential for agreements with other states for the reciprocal honoring of hunting and fishing licenses for the disabled. SL 2007-2.

 

S361, Waiver of Enforcement/No-Wake Zones, Jean Preston (Carteret-R); co: Boseman, Brown, Soles. Allows the Wildlife Resources Commission to temporarily waive enforcement of a no-wake zone upon petition by a local government. SL 2007-46.

 

S363, Ashe/Trapping of Raccoons, Steve Goss (Watauga-D). Establishes a season for raccoons in Ashe County, conditions on use of leghold traps. SL 2007-52.

 

S364, Ashe/Trapping of Foxes, Steve Goss (Watauga-D). Establishes a season for hunting foxes in Ashe County, with conditions on use of leghold traps and a bag limit. SL 2007-51.

 

S473, Stanly/No Hunting on Private Property, Bill Purcell (Scotland-D). Makes it illegal to hunt on someone’s property without written permission or under the influence of drugs or alcohol. SL 2007-264.

 

S493, Bertie County Hunting, Ed Jones (Halifax-D). Regulates hunting along public roads and requires written permission to hunt, fish or trap on private land in Bertie County. SL 2007-313.

 

S1246, Prohibit Baiting of Bears, Clark Jenkins (Edgecombe-D). Prohibits baiting black bears during open season by placing processed foods in areas frequented by bears. SL 2007-96.

 

S1303, Mountain Heritage Trout Waters Program, Joe Sam Queen (Haywood-D). Establishes a program by which people can get a short-term license to fish for trout in heritage public mountain trout waters that run through cities and towns. SL 2007-408.

 

S1365, Amend Wildlife Conservation Account, Kay Hagan (Guilford-D). As originally introduced, would have made the Wildlife Conservation Account non-reverting so that all funds remain until expended, but the final bill instead credits any interest earned to the account. SL 2007-448.

 

S1464, Amend Wildlife Management Laws, A.B. Swindell (Nash-D). Makes various changes to wildlife resources laws: authorizes the WRC to write emergency rules to respond to disease threats, allows taking of beaver with bow and arrow, requires hunters during deer firearm hunting season to wear hunter orange, prohibits feeding alligators, allows the use of electronic calling devices for snow geese and calls for a study of tracking of wounded deer after legal hunting hours. SL 2007-401.

 

Other

H714, Budget Technical Corrections 2007, Mickey Michaux (Durham-D), Alma Adams (Guilford-D), Martha Alexander (Mecklenburg-D), Jim Crawford (Granville-D). The annual budget technical corrections bill contains a provision, added in the Senate, allowing the Aquariums Fund to be used for capital projects. SL 2007-345.

 

H1473, 2007 Appropriations Act, Mickey Michaux (Durham-D), Jim Crawford (Granville-D), Douglas Yongue (Scotland-D); co: Adams, Alexander, Haire, Jeffus, Tolson. The state budget. SL 2007-323.

S844, Amend Environmental Laws 2007/Technical Corrections, Charlie Albertson (Duplin-D). The annual omnibus amendments bill to make changes various changes to existing laws and technical corrections.
